Acceptable Use Policy

ACCEPTABLE USE POLICY (AUP)

This Acceptable Use Policy ("AUP") governs the use of Unwired Access services and is incorporated by reference into the Master Services Agreement ("MSA").

Violation of this AUP constitutes a material breach of the MSA and may result in suspension or termination of service without notice.

1. GENERAL USE REQUIREMENTS

  • You agree to use Unwired Access services only for lawful purposes and in accordance with:
    • - All applicable local, state, and federal laws
    • - This AUP
    • - The MSA and any applicable addenda
  • You are responsible for all activity conducted through your account, whether authorized by you or not.

2. PROHIBITED ACTIVITIES

You may not, directly or indirectly:

2.1 Illegal or Harmful Use

  • Use the services for any unlawful purpose
  • Transmit, store, or distribute illegal content
  • Facilitate fraud, phishing, identity theft, or deception
  • Violate intellectual property rights

2.2 Network Abuse

  • Attempt to bypass, probe, or compromise network security
  • Introduce malware, viruses, worms, or malicious code
  • Conduct denial-of-service (DoS/DDoS) attacks
  • Use the service to interfere with other users or networks

2.3 Resale & Redistribution

  • Resell, share, or redistribute service outside the subscribed premises
  • Provide service to third parties, tenants, or the public without written authorization
  • Operate hotspots, relays, or repeaters without approval

2.4 Excessive or Abusive Use

  • Generate traffic patterns that negatively impact the network
  • Use automated systems that consume unreasonable bandwidth
  • Operate servers or services that materially degrade service quality
  • Unwired Access reserves the right to define what constitutes excessive or abusive use.

3. SECURITY RESPONSIBILITIES

You are responsible for:

  • Securing your internal network and devices
  • Preventing unauthorized access
  • Maintaining updated firmware and software on customer-owned equipment

Unwired Access is not responsible for compromises caused by customer misconfiguration or unsecured devices.

4. MONITORING & ENFORCEMENT

Unwired Access may:

  • Monitor network usage to ensure compliance
  • Investigate suspected violations
  • Suspend or terminate service immediately for violations
  • Cooperate with law enforcement when required by law

No monitoring obligation is assumed.

5. NO WAIVER

Failure to enforce this AUP in any instance does not waive Unwired Access's right to enforce it later.

6. MODIFICATIONS

This AUP may be updated at any time. Continued use of the services constitutes acceptance of the revised policy.
